INNAN Terms and Conditions

1. Scope

1.1 These Terms and Conditions of INNAN (hereinafter "Seller") are applicable to all contracts concluded by a consumer or entrepreneur (hereinafter "Customer") with the Seller with regard to the goods and/or services presented by the Seller in this online shop via Hereby the inclusion of own conditions of the customer is ruled out, unless otherwise agreed upon.

1.2 A „Consumer“ in the sense of these Terms and Conditions is every natural person who enters into a legal transaction for purposes that predominantly are outside his trade, business or profession. An „Entrepreneur“ within the meaning of these Terms and Conditions is a natural or legal person or a partnership with legal personality who or which, when entering into a legal transaction, acts in exercise of his or its trade, business or profession.

2. Conclusion of the Contract

2.1 Your purchase agreement is concluded with the Seller, mentioned in Point 1. 3 of our Terms and Conditions.

2.2 In order to place orders on our webshop, you must be at least 18 years of age or have reached the age required by your jurisdiction to effectively enter into a contract with INNAN and be a consumer and not a reseller.

2.3 The presentation of the items in our webshop is not a legally binding offer, but an invitation to order.

2.4 Once you have found the desired product, you can add it to your shopping cart without obligation by clicking the button “Add to cart”. You can view the contents of the shopping cart at any time by clicking the cart symbol in the menu. You can remove the products from the shopping cart at any time or add the new one by clicking the button “+” and “-”. If you want to buy the products from the shopping cart, click the button “Check out”. After input of your data you can choose the mode of shipping by clicking the button "Continue to shipping method". After choose the mode of shipping you choose the payment method by clicking the button “Continue to payment method”. After choosing the payment method you can check you order by clicking the button "Review order".

2.5 If you used an instant payment system (e.g. PayPal / PayPal Express), you will either be guided by clicking the button “Complete order” to our online shop on the order summary page or forwarded to the web page of the instant payment provider. In the case of redirection to the page of the instant payment system, please enter the required payment information. After this you will be returned to the summary page in our webshop.
Please review your order information and after this actively agree to the General Terms and Conditions and the Cancellation Policy. By clicking the button “Complete the order” you complete the order process.

2.6 We will confirm the receipt of your order by e-mail immediately after receiving your order. This confirmation of receipt does not yet represent an acceptance of your purchase offer, but only confirms the receipt of your order. The purchase contract is only concluded if we accept your order within 5 working days after receipt of your order by an order confirmation by email.

2.7 Should the Seller for various reasons classify an order as unserious or unreasonable, she is entitled to refuse an order acceptance.

2.8 Order processing and contacting usually takes place via email in a partially-automated manner. It is your responsibility to ensure that the e-mail address you provide us is accurate so that our emails can be received at this address. Particularly, if SPAM filters are used, you have to ensure that our emails or emails by third parties commissioned by us with the order processing can be delivered.

3. Contractual language and text of the contract

3.1 Contractual language is English

3.2 We do not save the complete text of the contract on our website. Before sending the order via the online shopping cart system, you can print or electronically save the contract information using the browser's print function. As soon as your order data is received by us, the order information, the legally prescribed information related to distance selling contracts and the general order terms are sent again to you per e-mail.

3.3 The current version of the General Terms and Conditions can be viewed on our website at any time.

4. Availability

4.1 All items, which you can see on the offer sides, are not immediately available. Each piece of jewellery is produced individually and therefore requires a production time of approx. 2 weeks plus delivery time unless otherwise stated on a product page. Should delays in delivery (e.g. due to the designer's holiday or similar) occur, you will be informed about it immediately after a purchase or before though the notice on our website. The designer reserves the right to change the offer at at any time.

4.2  Occasionally there are certain products offered on this website, which are available in stock to be shipped within 2-3 working days after the purchase has been done (please check product page for the production time). It does not mean, they are not handcrafted one at a time. They are simply pre-made by hand to make you wait less for the purchased item.

4.3 If you are interested in a product that is no longer in stock the next time you visit, please contact the designer and find out whether she can produce the corresponding product for you again in a similar way, which is usually the case. Also if you would like to order an individual product, a very special unique specimen for you which is not presented on our website, please contact the owner personally using the contact form.

5. Sizing and Resizing policy

5.1 The rings are offered either in our standard sizes 48, 50, 52, 54, 56, 58, 60, 62, 64, 66 or in a particular custom range of sizes based on a production complexity. The pendants are offered in three types of lengths: S (45 cm), M (60 cm), L (90 cm) if not stated otherwise. The earrings, ear cuffs, bracelets and necklaces are offered in one size.

5.2 We are responsible for sending you the ring size you ordered, but we cannot be responsible for defining your ring size. Please measure carefully, the final size remains your responsibility. Please make sure you determined your current ring size according to our ring size guide and noted our ring sizing policy.

5.3 If you wish the ring to be resized, please contact us. In some cases it is very easy to do and won’t take long. In some cases, it is a complex and time-consuming process (especially if multiple gemstones are involved). We are happy to discuss with you your particular case and find the most suitable solution.

5.4 Resizing costs are individual, depend on the ring type and will be determined separately for each case.

6. Prices and payment conditions

6.1 All prices mentioned in our offers include VAT and other price components, including all the incidental taxes and do not include shipping costs. Shipping costs will be charged extra (the standard shipping for the orders within the EU is free of charge). The payment is due immediately after the conclusion of the contract, unless the parties have arranged a later maturity date.

6.2 Orders from outside the European Union may cause additional costs such as duties, taxes or money transfer/ exchange fees, which you must bear.

6.3 Payment can be made using one of the methods mentioned in our webshop. At the moment we use following payment methods: PayPal, Payment via Credit/Debit Card (offered by Stripe).

6.4 When payments are made using a payment method offered by PayPal, handling of payments takes place via the payment service provider PayPal ((Europe) S.a. r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter called “PayPal”) subject to the PayPal terms of use which can be viewed at:

6.5 Payments via credit or debit card are provided by Stripe and are subject to Stripe Terms of Service (collectively, the “Stripe Services Agreement”). By agreeing to this Agreement or continuing the payment on our website, you agree to be bound by the Stripe Services Agreement, as the same may be modified by Stripe from time to time. As a condition of INNAN enabling payment processing services through Stripe, you agree to provide us accurate and complete information about you and you authorize us to share it and transaction information related to your use of the payment processing services provided by Stripe. 7. Retention of title

The goods remain our property until full payment has been received.

8. Delivery terms

8.1 The products are delivered all over the world except for Russia.

8.2 Shipping costs will be charged additionally and shown separately on the product page, in the shopping cart system and on the order page.

8.3 Each piece is manufactured individually and made to order. Taking into account the production time, the delivery time is longer than standard DHL delivery times. The delivery conditions, the delivery time as well as any existing delivery restrictions can be found under an appropriately designated button on our website or in the respective offer. The delivery time will be based on the expected delivery date.

8.4 If a delivery should come back because of undeliverability due to an error in the delivery address indicated by the buyer, the Seller must insist unfortunately on a renewed instruction of the forwarding expenses.

8.5 If the buyer insists on delivery by an alternative shipping company, this must be clearly stated in the purchase process or clarified before the purchase.

8.6 If you request a different type of shipment than the standard shipment offered by our webshop (Standard DHL Shipping and DHL Express Shipping), the shipping costs will be replaced up to the amount of the offered costs of a standard shipment in case of cancelation of your order.

9. Warranty

9.1 The statutory warranty rights are applicable to all items in our webshop.

9.2 As a consumer, you are requested to check the goods immediately upon delivery for completeness, visible defects and transport damage and to notify us and the shipping company in the written form of any complaints as quickly as possible. Should you fail to comply therewith, this shall not affect your statutory or contractual claims for defects.

10. Right of revocation

10.1 Revocation right for consumers

(A ‘consumer’ is any natural person who concludes a legal transaction which, to an overwhelming extent, cannot be attributed to either his commercial or independent professional activities.)

10.2 Instructions for revocation

10.2.1 You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date on which you as a consumer or a third party named by the consumer, such third party not being a carrier, has received the goods.

10.2.2 The right of revocation does not apply on contracts for delivery of products, which are not prefabricated and for whose manufacturing an individual selection or stipulation by the consumer is important or which are clearly tailored to the personal requirements of the consumer.

10.2.3 To exercise your right of revocation, you have to notify us:

of your decision to revoke from this contract by means of an explicit declaration (e.g., by a letter sent by post mail, fax or email). You can use the accompanying cancellation form (download from our website), however this is not required. In order to comply with the revocation period, it is sufficient that you send the notification about the exercise of the revocation right before the expiry of the revocation period.

10.2.4 Consequences of the revocation
If you revoke this contract, we shall repay all the payments, which we received from you, including the delivery costs (with the exception of additional costs, which arise from that fact that you selected a form of delivery other than the most reasonable standard delivery offered by us), immediately and at the latest within fourteen days from the day on which we received the notification about the revocation of this contract from you. We use the same means of payment, which you had originally used during the original transaction, for this repayment unless expressly agreed otherwise with you; you will not be charged any fees owing to this repayment.

10.2.5 We can refuse the repayment until the products are returned to us or until you have furnished evidence that you have sent the products back to us, depending on whichever is earlier.

immediately and, in any case, at the latest within fourteen days with effect from the day on which you inform us of the revocation of this contract. The deadline is maintained if you send the products before the expiry of the fourteen-day deadline. The products must be sent back as a package with a tracking number or registered mail with a required signature upon delivery.

10.2.7 You bear the direct costs for returning the products.

10.2.8 You must pay for any depreciation of the products only if this depreciation can be attributed to any handling with you that was not necessary for checking the condition, features and functionality of the products.

11. Applicable law

11.1 The law of the Federal Republic of Germany shall apply.

11.2 For consumers, this choice of law only applies to the extent that the granted protection is not withdrawn by mandatory provisions of the law of the country, in which the consumer has his habitual residence.

11.3 The provisions of the UN Convention are explicitly inapplicable.

12. Alternative dispute resolution

12.1 The European Commission offers the possibility for online dispute resolution on one of their online platforms. This platform can be accessed via the external link

12.2 We are neither willing nor obliged to participate in dispute settlement proceedings before a consumer arbitration board.
