1. Scope
1.1 These Terms and Conditions of INNAN (hereinafter "Seller") are applicable to all contracts concluded by a consumer or entrepreneur (hereinafter "Customer") with the Seller with regard to the goods and/or services presented by the Seller in this online shop via https://innan-jewellery.com. Hereby the inclusion of own conditions of the customer is ruled out, unless otherwise agreed upon.
1.2 A „Consumer“ in the sense of these Terms and Conditions is every natural person who enters into a legal transaction for purposes that predominantly are outside his trade, business or profession. An „Entrepreneur“ within the meaning of these Terms and Conditions is a natural or legal person or a partnership with legal personality who or which, when entering into a legal transaction, acts in exercise of his or its trade, business or profession.

2. Conclusion of the Contract
2.1 Your purchase agreement is concluded with the Seller, mentioned in Point 1. 3 of our Terms and Conditions.
2.2 In order to place orders on our webshop, you must be at least 18 years of age or have reached the age required by your jurisdiction to effectively enter into a contract with INNAN and be a consumer and not a reseller.
2.3 The presentation of the items in our webshop is not a legally binding offer, but an invitation to order.
2.4 Once you have found the desired product, you can add it to your shopping cart without obligation by clicking the button “Add to cart”. You can view the contents of the shopping cart at any time by clicking the cart symbol in the menu. You can remove the products from the shopping cart at any time or add the new one by clicking the button “Remove” and “Add to cart”. If you want to buy the products from the shopping cart, click the button “Check out”. After input of your data you can choose the mode of shipping. After choosing the mode of shipping you choose the payment method. After choosing the payment method you can check you order by clicking the button "Review order".
2.5 If you used an instant payment system (e.g. PayPal / PayPal Express), you will either be guided by clicking the button “Complete order” to our online shop on the order summary page or forwarded to the web page of the instant payment provider. In the case of redirection to the page of the instant payment system, please enter the required payment information. After this you will be returned to the summary page in our webshop. Please review your order information and after this actively agree to the General Terms and Conditions and the Cancellation Policy. By clicking the button “Pay now” you complete the order process.
2.6 We will confirm the receipt of your order by e-mail immediately after receiving your order. This confirmation of receipt does not yet represent an acceptance of your purchase offer, but only confirms the receipt of your order. The purchase contract is only concluded if we accept your order within 5 working days after receipt of your order by an order confirmation by email.
2.7 We reserve the right not to accept the order.
2.8 Order processing and contacting usually takes place via email in a partially-automated manner. It is your responsibility to ensure that the e-mail address you provide us is accurate so that our emails can be received at this address. Particularly, if SPAM filters are used, you have to ensure that our emails or emails by third parties commissioned by us with the order processing can be delivered.
3. Contractual language and text of the contract
3.1 German and English languages are exclusively available for the conclusion of the contract. The language selection will be displayed in the webshop.
3.2 We do not save the complete text of the contract on our website. Before sending the order via the online shopping cart system, you can print or electronically save the contract information using the browser's print function. As soon as your order data is received by us, the order information, the legally prescribed information related to distance selling contracts and the general order terms are sent again to you per e-mail.
3.3 The version of the General Terms and Conditions that is valid at the time of the order applies. Deviating provisions are only valid if they have been confirmed in writing by the seller. The current version of the General Terms and Conditions can be viewed on our website at any time.
4. Products
4.1 We try to ensure that the information, including product descriptions, dimensions and colours displayed in the webshop is accurate and as complete as possible. We however do not guarantee accuracy and completeness of such information. Any description and information such as dimensions, the number of stones and carat weights are provided as an indication only and may vary slightly. We have made every effort to display our products accurately, however the images on our website are for illustrative purposes only. We also cannot guarantee that your screens display of the colours is an accurate reflection of the colour of the products.
4.2 If you are interested in a product with natural-coloured stones, the gemstones used can vary in colour and other visual characteristics. All our stones are natural, however when a product is reproduced, we cannot guarantee the colour will exactly match a previous piece. Each coloured stone product may vary in tone and colour.
4.3 The products sizes, colours, dimensions and measurements detailed on our website may not be precise. If you have any questions or would like to receive further specifications about the products of interest, please do contact us before confirming your order.
4.4 Personalisation services, such as engraving or changes to the design, may be available on selected products. If you wish to have your products personalised, please contact us with your request and we will let you know whether it will be possible, along with an estimated lead-time and quote.
4.5 We reserve the right to change the products shown in the online shop at any time and without prior notice, to limit the number of products that can be purchased by a customer, and to withhold or refuse to accept orders for personalized products.
4.6 All sales of products that have been personalised or otherwise made to your bespoke specifications are final and cannot be cancelled or returned to us for exchange or refund. For precautionary reasons, it should be noted that the right of withdrawal does not apply to contracts for the delivery of goods that are not pre-fabricated and for which the consumer has made an individual selection or specification, or that are customized to meet the personal needs of the consumer (see the 'Right of Revocation').
4.7 All information provided in the online shop regarding the availability and delivery times of goods is non-binding and without warranty.
5. Availability
5.1 The majority of products, which you can see on the offer sides, are not immediately available (except for ‘In Stock’ collection). Each piece of jewellery is produced individually and therefore requires a production time of approx. 14-20 working days plus delivery time. Please find information regarding the production time on each product page. Should delays in delivery (e.g. due to the designer's holiday or similar) occur, you will be informed about it immediately after a purchase or before though the notice on our website. The designer reserves the right to change the offer at https://innan-jewellery.com at any time.
5.2 Should a product be indicated as “In Stock” in our webshop, it will be shipped or ready for the pick up within 1-2 work days.
5.3 Should you require a faster production time, please contact us and we will do our best to accommodate your request if possible. Additional cost will apply, which will be estimated individually based on the product complexity and required time frame.
5.4 If you are interested in a product that is no longer in stock the next time you visit https://innan-jewellery.com, please contact us through the contact form to find out whether the corresponding product can be produced for you again in a similar way, which is usually the case. Also, if you would like to order an individual product, a very special unique specimen for you which is not presented on our website, please contact us using the contact form.
6. Sizing and Resizing policy
6.1 The rings are offered either in our standard sizes (48, 49, 50, 51, 52, 53, 54, 55, 56, 57, 58, 59, 60, 61, 62, 63) or in a particular custom range of sizes based on a production complexity. The pendants are offered in three types of lengths: S (45 cm), M (60 cm), L (90 cm) if not stated otherwise. The earrings, ear cuffs, bracelets and necklaces are offered in one size.
6.2 We are responsible for sending you the ring size you ordered, but we cannot be responsible for defining your ring size. Please measure carefully, the final size remains your responsibility. Please make sure you determined your current ring size according to our ring size guide and noted our ring sizing policy. For local orders, please visit our Berlin Atelier to get the ring size measured correctly. For international orders we recommend to get your size measured by a local jeweller. Also, the ring sizer can be shipped upon request after the order is confirmed.
6.3 If you wish the ring to be resized, please contact us. In some cases, it is an easy task and won’t take long. In some cases, it is a complex and time-consuming process (especially if multiple gemstones are involved) or not possible at all. We are happy to discuss with you your particular case and find the most suitable solution.
6.4 Resizing costs are individual, depend on the ring type and will be determined separately for each case.
7. Prices and payment conditions
7.1 All prices mentioned in our offers include VAT and other price components, including all the incidental taxes and do not include shipping costs. Shipping costs will be charged extra. The payment is due immediately after the conclusion of the contract, unless the parties have arranged a later maturity date.
7.2 Orders from outside the European Union may cause additional costs such as duties, taxes or money transfer/ exchange fees, which you must bear.
7.3 Payment can be made using one of the methods mentioned in our webshop.
For domestic deliveries (Germany) the following payment options are available:- Payment via credit card

7.3.1 When payments are made using a payment method offered by PayPal, handling of payments takes place via the payment service provider PayPal ((Europe) S.a. r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter called “PayPal”) subject to the PayPal terms of use which can be viewed at: https://www.paypal.com/de/webapps/mpp/ua/useragreement-full. The payment transaction will be carried out automatically by PayPal immediately afterwards. Further information can be found during the ordering process.
7.3.2 Payments via credit or debit card are provided by Stripe and are subject to Stripe Terms of Service (collectively, the “Stripe Services Agreement”). By agreeing to this Agreement or continuing the payment on our website, you agree to be bound by the Stripe Services Agreement, as the same may be modified by Stripe from time to time. As a condition of INNAN enabling payment processing services through Stripe, you agree to provide us accurate and complete information about you and you authorize us to share it and transaction information related to your use of the payment processing services provided by Stripe. Stripe's terms of use can be viewed at: https://stripe.com/de/checkout/legal.
7.3.3 When choosing a payment method offered via the payment service "Shopify Payments", payment will be processed via the payment service provider Shopify International Limited, Victoria Buildings, 2nd floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland (hereinafter referred to as "Shopify"). The individual payment methods offered via Shopify are communicated to customer in our webshop. Shopify may use other payment services to process payments, which may be subject to special payment terms, to which the customer is separately referred. Further information on "Shopify Payments" can be found at https://www.shopify.com/payments.
7.3.4 If the payment method "immediate bank transfer" is selected, payment processing is carried out via the payment service provider SOFORT GmbH, Theresienhöhe 12,80339 Munich (hereinafter referred to as "SOFORT"). If he wants to be able to pay the invoice amount via “immediate bank transfer,” the Client must have an online banking account that is activated for participation in “immediate bank transfer”. Furthermore, he must have the appropriate credentials during the payment process, and must confirm the payment instruction to SOFORT. The payment transaction will be executed immediately afterwards and the Client’s bank account debited accordingly. Further information on the payment method “immediate bank transfer” can be called up by the Customer at https://www.klarna.com/sofort/.
7.3.5 If a payment method offered via the payment service "Klarna" is selected, the payment will be processed via Klarna Bank AB (https://www.klarna.com/international/) Sveavägen 46, 111 34 Stockholm, Sweden (hereinafter "Klarna"). "Pay now with Klarna" method is currently available in our webshop.
7.4 We reserve the right to change prices for our products listed on the website at any time and without notice.
7.5 It is always possible that, some of the products we sell may be mistakenly incorrectly priced. Once an order is placed, we make sure the price of the product purchased is correct before accepting your order. If the product’s correct price at your order date is higher than the price stated in our website, we will contact you for further instructions before we accept your order. If the correct price is higher than the displayed price, the customer can cancel the order at no cost. If we are unable to reach you using the contact details you have provided during the order process, we will cancel the order.
7.6 For further information regarding payment and shipping, please refer to 'Payment and Shipping'.
8. Retention of title
The goods remain our property until full payment has been received. If payment is delayed by more than 10 days, we reserve the right to terminate the contract.
9. Delivery terms
9.1 The products are delivered all over the world except for Russia, Belarus, India and China. Generally, items are shipped with the shipping carrier DHL.
9.2 Shipping costs will be charged additionally and shown separately on the product page, in the shopping cart system and on the order page.
9.3 Each piece that is not marked ‘In Stock’ is manufactured individually and made to order. Taking into account the production time, the delivery time is longer than standard DHL delivery times. The delivery conditions, the delivery time as well as any existing delivery restrictions can be found under an appropriately designated button on our website or in the respective offer. The delivery time will be based on the expected delivery date.
9.4 The products marked ‘In Stock’ will be shipped / ready for the pick up within 1-2 work days.
9.5 If a delivery should come back because of undeliverability due to an error in the delivery address indicated by the buyer, the Seller must insist unfortunately on a renewed instruction of the forwarding expenses.
9.6 If the buyer insists on delivery by an alternative shipping company, this must be clearly stated in the purchase process or clarified before the purchase.
9.7 If the buyer requests express delivery or a different type of shipment than the standard shipment offered by our webshop (Standard DHL Shipping), the shipping costs will be replaced up to the amount of the offered costs of a standard shipment in case of cancelation of your order.
9.8 Local Atelier pick up is available as a delivery option. If you would like to collect your order, please let us know by selecting this option during the checkout process. We will contact you to arrange a date and time during the Atelier opening hours (Tuesday 12:00 - 18.00, Wednesday to Saturday 12:00 – 19.00).
10. Warranty
10.1 The statutory warranty rights are applicable to all items in our webshop.
10.2 As a consumer, you are requested to check the goods immediately upon delivery for completeness, visible defects and transport damage and to notify us and the shipping company in the written form of any complaints as quickly as possible. Should you fail to comply therewith, this shall not affect your statutory or contractual claims for defects.
11.Redemption of Gift Cards
11.1 Gift cards can be purchased via our webshop or via email request at info@innan-jewellery.com and are valid for 3 years from the date of purchase.
11.2 The gift card purchased through the webshop will be emailed to the customer along with the instructions on how to redeem. The physical version of the gift card can be sent per post, please contact us for this option.
11.3 Gift cards are offered in a value of 100, 250, 500, 750 and 1000€. Please contact us for a different custom amount.
11.4 Gift cards can only be redeemed prior to the conclusion of the order procedure. Subsequent offsetting is not possible.
11.5 Only one gift card can be redeemed per order.
11.6 Gift cards can only be used for the purchase of goods and not for the purchase of other gift cards.
11.7 If the value of the gift card is not enough for the order, the client may choose one of the remaining payment methods offered by the seller to pay the difference.
11.8 The gift card credit will not be redeemed in cash and is not subject to any interest.
12. Right of revocation
12.1 Revocation right for consumers
As a consumer, you have the right of withdrawal in accordance with the information provided in the appendix „Right of revocation". A consumer is any natural person who enters into legal transactions for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity. 13. Limitation of Liability
13.1 We are liable for intent and gross negligence. Furthermore, we are liable for the negligent breach of obligations that are essential for the proper execution of the contract, the breach of which jeopardizes the achievement of the contract's purpose, and on the compliance of which you may regularly rely. In the latter case, however, our liability is limited to foreseeable, contract-typical damages. We are not liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences. The aforementioned exclusions of liability do not apply in cases of injury to life, body, or health. Liability under the Product Liability Act remains unaffected.
13.2 Data communication over the Internet cannot be guaranteed to be error-free and/or available at all times according to the current state of technology. Therefore, we do not assume liability for the constant and uninterrupted availability of our online shop.
14. Applicable law
14.1 The law of the Federal Republic of Germany shall apply.
14.2 For consumers, this choice of law only applies to the extent that the granted protection is not withdrawn by mandatory provisions of the law of the country, in which the consumer has his habitual residence.
14.3 The provisions of the UN Convention are explicitly inapplicable.
15. Alternative dispute resolution
15.1 The European Commission offers the possibility for online dispute resolution on one of their online platforms. This platform can be accessed via the external link http://ec.europa.eu/consumers/odr/.
15.2 We are neither willing nor obliged to participate in dispute settlement proceedings before a consumer arbitration board.
