1. Scope

1.1 These Terms and Conditions of INNAN (hereinafter Seller”) are applicable to all contracts concluded by a “Consumer” or “Entrepreneur” (both defined below; hereinafter either referred to as “Customer”) with the Seller with regard to the goods and/or services presented by the Seller in this online shop via https://innan-jewellery.com. The inclusion of the Customer’s own terms and conditions is excluded unless otherwise agreed in writing.

1.2 A “Consumer“ in the sense of these Terms and Conditions is every individual acting for purposes which are wholly or mainly outside those individual’s trade, business, craft or profession. An “Entrepreneur“ within the meaning of these Terms and Conditions is a natural or legal person or a partnership with legal personality who or which, when entering into a legal transaction, acts in exercise of his or its trade, business or profession.

2. Conclusion of the Contract

2.1 In order to place orders on our webshop, you must be at least 18 years of age or have reached the age required by your jurisdiction to effectively enter into a contract with the Seller. Products offered in our webshop are intended for personal use only. Any resale or commercial distribution of our products without our prior written consent is prohibited.

2.2 The presentation of the items in our webshop is not a legally binding offer, but an invitation to place an order.

2.3 You are responsible for checking and confirming that all details and aspects of your order are correct and suitable for your requirements, including, but not limited to (where applicable), ring size, gold carat, necklace size, production time and delivery.

2.4 You may submit product enquiries through the contact form available on our website. By selecting a product and clicking the relevant “Add to cart” button, the product is placed into your shopping cart without obligation. You may review, modify or remove the products in your shopping cart at any time before submitting your order. During the checkout process, you will be asked to provide your contact and shipping information, select a shipping method and choose a payment method. Before submitting the order, you will have the opportunity to review all order details and correct any input errors.

2.5 If you choose an instant payment method, such as PayPal, PayPal Express or similar services, you may be redirected to the website of the respective payment provider to complete the payment process. After successful authentication and entry of the required payment information, you will be returned to our webshop where you will have the opportunity to review your order details before finally submitting the order. By submitting the order, you confirm that you have read and accepted these Terms and Conditions as well as our “Exchanges and Returns“ and "Right of withdrawal" policies. 

2.6 After placing an order through our website, you will receive an automatic confirmation email from us acknowledging receipt of your order. This confirmation does not constitute acceptance of your order. Your order constitutes an offer to buy a product from us. A binding contract is concluded only once we expressly accept your order by separate confirmation or dispatch the ordered product. We reserve the right to refuse or cancel orders in individual cases where reasonably justified, in which case any amount paid will be refunded in full via the original payment method.

2.7 Order processing and communication generally take place via email and may be partially automated. It is your responsibility to ensure that the email address provided is accurate so that our emails can be received at this address. Particularly, if spam filters are used, you must ensure that our emails, or emails by third parties commissioned by us for order processing, can be delivered.

3. Contractual Language and Text of the Contract

3.1 The contract may be concluded exclusively in German or English. The language selection will be displayed in the webshop.

3.2 We do not save the complete text of the contract after the order process has been completed. Before submitting the order via the online shopping cart system, you may print or electronically save the contract information using your browser function. As soon as your order data is received by us, the order details, these Terms and Conditions and all legally required information relating to distance selling contracts will be sent to you by email. 

3.3 The version of these Terms and Conditions valid at the time the order is placed shall apply. Any deviating provisions are only valid if expressly confirmed by the Seller in writing. The current version of these Terms and Conditions can be viewed on our website at any time. 

4. Products

4.1 We make every reasonable effort to ensure that the information displayed in our webshop, including product descriptions, dimensions, colours and other product details, is accurate and complete. However, slight variations and inaccuracies may occasionally occur. Any descriptions, measurements, stone quantities and carat weights are provided for informational purposes only and may vary slightly from the final product. Product images on our website are for illustrative purposes only. While we aim to display colours as accurately as possible, we cannot guarantee that your device’s display will accurately reflect the actual colours of the products.

4.2 Products featuring natural-coloured gemstones may vary in colour, tone and other visual characteristics. As all gemstones used by us are natural, each stone is unique and may differ slightly from the images displayed on our website or from previously produced pieces. We therefore cannot guarantee an exact match in colour or appearance between individual products

4.3 Products sizes, colours, dimensions and measurements detailed on our website may vary slightly. If you have any questions or would like to receive further specifications about a product, please contact us before placing your order.

4.4 Personalisation services, such as engraving or changes to the design, may be available on selected products. If you wish to have your products personalised, please contact us with your request and we will let you know whether it will be possible, along with an estimated lead-time and quotation.

4.5 We reserve the right to modify or discontinue products displayed in our webshop at any time and without prior notice, to limit the quantities available for purchase, and to decline orders for personalised products in individual cases.

4.6 Products that have been personalised or otherwise made according to the Customer’s bespoke specifications are excluded from withdrawal, exchange and return rights unless otherwise required by mandatory law. Please note that the statutory right of withdrawal does not apply to contracts for the supply of goods that are made to the Consumer’s specifications or that are customised to meet the personal needs of the Consumer (see for further information our “Right of Withdrawal” policy).

4.7 All information provided in our webshop regarding product availability and estimated delivery times is non-binding and subject to change

5. Availability

5.1 The majority of products displayed in our webshop are made to order and are therefore not immediately available (except for our “In Stock” collection). Each jewellery piece is individually handcrafted and generally requires a production time of approximately 3-4 weeks, plus delivery time. Wedding and engagement rings may require approximately 5-7 weeks of production time, plus delivery time. Estimated production times are indicated on the respective product pages. Should delays occur, we will inform you as soon as reasonably possible, either directly after purchase or through notices published on our website. We reserve the right to modify the product offering available on our website at https://innan-jewellery.com at any time.

5.2 We offer three types of bespoke services: one-of-a-kind commissions, tailored personalisations and heirloom resetting. 

One-of-a-kind commissions - fully bespoke jewellery creations developed together with Inna, including custom design development and gemstone sourcing. Estimated production time: up to 12 weeks after order confirmation and gemstone sourcing. 

Tailored personalisations - personalisation of an existing INNAN design through alternative metals, gemstones or selected modifications. Estimated production time: approximately 5–8 weeks. 

Heirloom resetting - transformation of heirloom jewellery into contemporary INNAN designs using selected original materials or gemstones. Production timelines may vary depending on project complexity and technical requirements.

5.3 Products marked as “In Stock” will generally be shipped or made available for collection within 1–2 business days. 

5.4 Should you require a shorter production timeline, please contact us before placing your order and we will do our best to accommodate your request where possible. Additional charges may apply, which will be estimated individually based on the product complexity and required time frame. 

5.5 If a product is no longer in stock when you revisit our webshop, please contact us via the contact form to enquire whether a similar piece can be reproduced for you, which is often possible. We also welcome enquiries regarding fully bespoke jewellery pieces or custom projects that are not displayed on our website.

6. Sizing and Resizing Policy

6.1 Rings are available in our standard sizes (4663) or in selected custom size ranges, depending on production complexity. Pendants are generally offered in three types of lengths: S (45 cm), M (60 cm), and L (90 cm), unless stated otherwise. Earrings, ear cuffs, bracelets and necklaces are generally offered in one size.

6.2 We are responsible for delivering the ring size you ordered; however, determining the correct ring size remains the Customer’s responsibility. Please ensure that your ring size has been measured carefully in accordance with our ring size guide and sizing policy before placing an order. For local orders, we recommend visiting our Berlin Atelier to get the ring size measured correctly. For international orders, we recommend having your ring size measured by a local jeweller. A ring sizer may be provided upon request after order confirmation.

6.3 If you require a ring resizing, please contact us to discuss the available options. Depending on the design and technical complexity of the piece, resizing may be simple and straightforward or, in certain cases (especially if multiple gemstones are involved) more complex or not possible at all. We will be happy to advise you individually and find the most suitable solution.

6.4 Resizing costs are determined individually and depend on the design, construction and complexity of the respective ring.

7. Prices and Payment Conditions

7.1 All prices displayed in our webshop are stated in euros and include the applicable statutory VAT and any other price components, unless expressly stated otherwise. Shipping costs are not included in the product prices and will be shown separately during the checkout process before the order is submitted . Payment is due upon submission of the order or in accordance with the payment method selected during checkout, unless the parties have arranged a later maturity date.

7.2 For deliveries outside the European Union, additional costs may apply, including customs duties, import taxes, bank charges or currency exchange fees. Such costs are not included in the product or shipping prices and must be borne by the Customer.

7.3 Payment may be made using the payment methods offered in our webshop during the checkout process. The available payment methods may vary depending on the delivery country, order value and technical availability of the respective payment service providers. The payment methods currently available may include credit card, PayPal, Klarna, Sofort bank transfer and other payment services offered via Shopify Payments or third-party payment providers. 

7.3.1 Payments are processed by the respective payment service providers selected during checkout, such as PayPal, Klarna, Stripe, Shopify Payments or other providers. The use of a particular payment method may be subject to the terms and conditions of the respective payment service provider, which will be made available during the payment process where applicable.

7.3.2 If payment is made via an instant payment method, the payment transaction may be carried out immediately after the order is submitted. Further information will be provided during the checkout and payment process.

7.4 Product prices may change from time to time, in particular due to fluctuations in material costs, including the price of gold and gemstones. We reserve the right to change the prices of our products displayed in our webshop at any time without prior notice. Such price changes do not affect orders that have already been accepted by us.

7.5 Despite our reasonable efforts, products may occasionally be incorrectly priced due to technical, typographical or other errors. We verify the price of the ordered product before accepting the order. If the correct price of a product is higher than the price displayed in the webshop at the time of the order, we will contact you before accepting the order and give you the option to proceed with the order at the correct price or cancel the order free of charge. If we are unable to contact you using the contact details provided during the order process, we reserve the right not to accept the order. Any payments already made will be refunded in full via the original payment method.

7.6 Further information regarding available payment methods can be found in our separate “Payment” policy. Further information regarding shipping costs, delivery options and estimated delivery periods can be found in our separate “Shipping” policy. 

8. Retention of Title 

The goods remain our property until full payment of the purchase price has been received. If payment is not received or is subsequently reversed, we reserve the right to withdraw from the contract and reclaim the goods, where legally permissible.

9. Delivery Terms

9.1 Shipping is currently available only to selected countries listed at checkout. If your country is not listed, please contact us to enquire about a possible shipment arrangement.

9.2 Shipping is carried out through trusted logistics partners, currently including DHL and UPS. The choice of carrier is made at our discretion based on the value of your order, in order to ensure maximum protection during transit. Orders with a value exceeding EUR 500 are generally shipped via UPS (UPS Express Saver), unless otherwise agreed or required in individual cases.

9.3 Shipping costs will be charged additionally and shown separately on the product page, in the shopping cart system and during checkout before the order is submitted.

9.4 Products that are not marked as “In Stock” are individually made to order. Accordingly, the overall delivery timeframe consists of the applicable production time plus shipping time. Estimated production and delivery times, as well as any delivery restrictions, are displayed on the relevant product page or during checkout.

9.5 Products marked as “In Stock” will generally be shipped or made available for collection within 1-2 business days.

9.6 If a shipment is returned to us because delivery was not possible due to an incorrect or incomplete delivery address provided by the Customer, the Customer shall bear any additional shipping costs for renewed dispatch, unless the Customer is not responsible for the failed delivery.

9.7 If the Customer requests delivery by a specific or alternative shipping company, this must be agreed with us before the order is placed or clearly indicated during the order process. Additional costs may apply. 

9.8 If the Customer chooses a delivery method that is more expensive than the standard delivery option offered by us, any reimbursement of shipping costs in the event of withdrawal will be limited to the amount of the least expensive standard delivery option offered by us, unless otherwise required by mandatory law.

9.9 Local Atelier collection is available as a delivery option. If you wish to collect your order from our Berlin Atelier, please let us know by selecting this option during the checkout process. As soon as your order is ready for collection, you will be notified and asked to arrange a collection appointment via the booking link provided. Collection is available during the Atelier opening hours (currently Wednesday - Saturday 12:00-19.00).

10. Warranty 

10.1 The statutory warranty rights apply to all products purchased through our webshop. All INNAN jewellery is handcrafted in our Berlin Atelier. In the event of damage, we may offer repair services where technically possible. Normal wear and tear, improper handling, accidental damage or loss of jewellery are not covered by statutory warranty rights unless required by mandatory law.

10.2 Consumers are requested to inspect the goods upon delivery for completeness, visible defects and transport damage, and to notify us and the carrier of any complaints as quickly as possible. Failure to do so does not affect the Consumer’s statutory warranty rights.

10.3 Any repair, modification or alteration carried out on INNAN jewellery by a third party, including another jeweller, may affect the integrity of the piece. Statutory warranty rights remain unaffected; however, claims may be excluded to the extent that a defect or damage was caused by such third-party work or alteration. 

11. Redemption of Gift Cards

11.1 Gift cards may be purchased via our webshop or via email request at info@innan-jewellery.com and are valid for 3 years from the date of purchase.

11.2 Gift cards purchased through our webshop will be sent to the Customer by email together with the redemption instructions. A physical version of the gift card can be sent by post upon request. 

11.3 Gift cards are offered in values of EUR 100, EUR 250, EUR 500, EUR 750 and EUR 1,000. Please contact us for a different custom amount.

11.4 Gift cards can only be redeemed before the order is submitted. Subsequent offsetting is not possible.

11.5 Only one gift card can be redeemed per order, unless otherwise agreed with us.

11.6 Gift cards may only be used for the purchase of goods and not for the purchase of other gift cards.

11.7 If the value of the gift card is lower than the total order amount, the Customer may pay the remaining balance using one of the other payment methods offered in the webshop.

11.8 Gift card balances cannot be redeemed in cash and are not subject to any interest. Any remaining balance will remain available on the gift card until the expiry date.

12. Right of Withdrawal; Exchanges and Refunds

12.1 Information regarding the statutory right of withdrawal for Consumers, including the withdrawal instructions and model withdrawal form, can be found in our separate “Right of Withdrawalpolicy.

12.2 Additional information regarding voluntary exchanges, returns and related conditions can be found in our separate “Exchanges and Returns” policy. This does not affect the statutory rights of Consumers, including the statutory right of withdrawal and statutory warranty rights.

13. Limitation of Liability

13.1 We are liable without limitation for intent and gross negligence. We are also liable for the negligent breach of essential contractual obligations, i.e. obligations whose fulfilment is necessary for the proper performance of the contract and on whose compliance the Customer may regularly rely. In such cases, our liability is limited to foreseeable damages typical for this type of contract. We are not liable for slightly negligent breaches of obligations other than those mentioned above. The above limitations of liability do not apply in cases of injury to life, body or health, or where liability is mandatory under the German Product Liability Act. 

13.2 Data communication via the internet cannot be guaranteed to be error-free and/or available at all times according to the current state of technology. Therefore, we do not guarantee the constant and uninterrupted availability of our webshop. 

14. Applicable Law 

14.1 These Terms and Conditions and all contractual relationships between us and the Customer shall be governed by the laws of the Federal Republic of Germany.

14.2 For Consumers, this choice of law applies only to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence.

14.3 The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.

15. Alternative Dispute Resolution

15.1 We are neither willing nor obliged to participate in dispute resolution proceedings before a Consumer arbitration board.
